These Terms govern the Sculpt website and app services provided by Jacob Lagesse, 655 Bonanza Ct, Sunnyvale, CA 94087, USA. For support, contact sculpt.app.support@gmail.com. Read these Terms with our Privacy Policy, Consumer Health Data Privacy Notice and the software license that applies to your App Store download.
1. Eligibility and use
You must be at least 18, satisfy any higher applicable local age requirement, and have legal capacity to enter this agreement. Use your own account and provide accurate information. By using Sculpt, you agree to these Terms. If you do not agree, do not use the service. These Terms do not replace separately required consent for sensitive-data processing or sharing.
2. Fitness guidance and safety
Sculpt helps you set goals, view illustrative body models, plan or log training, request AI-assisted feedback, and follow progress. Features depend on availability, device compatibility, connectivity, region and subscription. Body models are illustrations, not predictions of how you will look.
Sculpt provides general fitness information. It is not a medical provider and does not diagnose, treat or monitor medical conditions. Body-fat estimates, muscle scores, calorie guidance and generated routines may be inaccurate or unsuitable for you. A body photo is not a validated medical measurement. No particular appearance, fitness or weight result is guaranteed.
Use appropriate technique, equipment and surroundings. Consult a qualified professional before changing exercise or diet when you have a health condition, injury, pregnancy, an eating disorder or other relevant concern. Do not use the app to override professional advice. Stop exercise if you experience concerning symptoms and seek appropriate care. Sculpt is not an emergency service.
3. Accounts
Keep your device and account secure. Contact us about suspected unauthorized access. We may restrict access proportionately to investigate misuse or protect users, with notices or appeal opportunities where required. You may stop using the service at any time.
4. Your inputs and AI outputs
Upload only your own appropriate fitness photos and information that you are entitled to provide. Do not submit images of minors, other people for body analysis, unlawful content, or unnecessary identifying information.
You retain rights in your inputs. You permit us and the service providers described in our privacy notices to process, transmit, store and display them as needed for the features you request. This permission does not authorize selling your photos, advertising use or unrelated model training.
OpenAI processes requested scan and routine inputs through our backend. AI output may contain errors, bias or omissions and may not be unique. Review outputs before acting on them. Automated output does not establish a relationship with a clinician or guarantee suitability for your circumstances.
5. Subscriptions and payments
The purchase screen displays the subscription's price, duration, included features and any trial or introductory terms. Apple processes App Store purchases under the purchase terms shown to you. Auto-renewing subscriptions continue and renew at the applicable price unless cancelled under those terms. Price changes are subject to required notice and consent rules.
Manage or cancel an App Store subscription through your Apple account. Deleting Sculpt, logging out, clearing local data or deleting your Sculpt account does not automatically cancel Apple billing. Restore purchases through the app where available. Refunds are handled through Apple's applicable process and your mandatory consumer rights. Nothing in these Terms removes a refund or other remedy required by law.
6. Acceptable use
Do not bypass access controls, interfere with the service, access another person's information without permission, falsify entitlement claims, resell unauthorized access, or use the service to harass or shame anyone. Do not present estimates as certified medical results. Restrictions on reverse engineering or similar activities do not apply where applicable law expressly permits them.
7. Intellectual property and license
Sculpt software, branding and content are owned by the operator or their licensors, apart from your inputs. The software license identified with your App Store download applies; where no custom license is provided, Apple's standard Licensed Application End User License Agreement applies. These Terms govern the associated services. Third-party notices and licenses remain applicable.
8. Privacy and deletion
Our privacy notices describe information collection, processing, sharing, retention and your rights. Request account deletion in Profile & settings > Account > Delete account, or email sculpt.app.support@gmail.com. Deletion can remove access to account records, so obtain any copy you need first. Apple subscription cancellation is separate.
9. Availability, suspension and changes
We aim to maintain Sculpt but cannot guarantee uninterrupted access or compatibility with every device. Some functions depend on connectivity and third-party services.
We may suspend or terminate access for a material breach or as otherwise permitted by law, acting proportionately and providing notice or an opportunity to remedy where appropriate. We will preserve applicable rights relating to paid services, including required refunds or other remedies.
We may update the service or these Terms, with any notice, consent or termination options required by law. Material changes affecting paid services remain subject to consumer protections. We will identify revised Terms by their effective date and provide additional notice when required.
10. Consumer protections and responsibility
Nothing in these Terms excludes or limits liability or remedies that cannot lawfully be excluded or limited, including applicable protections relating to fraud, deliberate misconduct, personal injury, consumer guarantees and data protection. You retain mandatory rights under the laws that apply to you. These Terms do not impose mandatory arbitration or a class-action waiver.

Mandatory law prevails over conflicting wording. The applicable software license governs the app license; these Terms govern the service. Our privacy notices explain data practices and do not expand the permissions granted for your inputs.
